BY ACCESSING OR OTHERWISE USING THE WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS OF USE (“TERMS”) AND AGREE TO ACCESS OR OTHERWISE USE THE SITE IN ACCORDANCE WITH THESE TERMS OF USE. SoundIntuition (called either “SoundIntuition”, “us” or “we” in this website) welcomes you to our website and electronic services available at www.soundintuition.com (collectively, the “Website”). 

1. PURPOSE AND MEDICAL DISCLAIMER

This website contains information and continuing education tools (videos) for medical and non-medical professionals engaged in the field of communication disorders and education (Professionals) and students studying communication disorders and education (Students) and is intended to assist them in meeting their continuing education or education requirements. We recognize it may also be used by laypersons seeking to increase their general knowledge and/or for informational purposes.
This website is NOT, nor is intended to be, nor should it be used as, a resource for medical or self-help or as a substitute for the advice of qualified professionals. Neither SoundIntuition nor any person whose name appears on the website in any context (blog, video, or otherwise) is providing information for the purpose of your self-diagnosis/treatment or the diagnosis/treatment of other people.
The content of online courses has been reviewed and approved for continuing educational purposes (only) by the professional bodies indicated, and not otherwise. 
Persons who are not qualified professionals or students who use this site for informational purposes are cautioned (again that this website is not, nor should it be used as, a resource for medical or non-medical self-help or as a substitute for the advice of qualified professionals. If you have any questions or concerns about your health and communication abilities or the health and communication abilities of others, you should consult your own physician or a qualified professional. 

2. OWNERSHIP / RESTRICTIONS ON USE

The Website is owned and operated by SoundIntuition.  Any and all content, data, graphics, photographs, images, audio, video, software, trademarks, service marks, trade names and other information (collectively, “Content”) contained in this Website are proprietary to SoundIntuition, its affiliates and/or third-party licensors.  The Content is protected by Canadian and international copyright and trademark laws. 
You may not modify, copy, download, reproduce, publish, resell, post, create derivative works from, transfer or sell any Content without either (i) following the steps outlined in e.g., our blog pages, or (ii) as specifically authorized by this Website, or (iii) our prior written consent.   To ask for our consent, please contact us at support@soundintuition.com. We reserve in any case the right to grant consents, grant conditional consents, or refuse consent, all in our sole discretion.

3. HYBERLINKS AND THIRD PARTY SITES

The Website may contain hyperlinks or references to third party website that are owned and operated by third parties and therefore not affiliated with SoundIntuition.  Any links SoundIntuition provide to other websites are provided as a convenience only and are independent from SoundIntuition. 
As such, SoundIntuition has no control over the content of such websites.  Consequently, SoundIntuition cannot be held liable and makes no warranty or representation whatsoever as to the accuracy, timeliness and/or completeness of the information contained on such websites.
The links which we might place on our Website do not imply that we sponsor, endorse or are affiliated or associated with, or have been legally authorized to use any trade-mark, trade name, service mark, design, logo, symbol or other copyrighted materials displayed on or accessible through those sites.

That said, we welcome any feedback that you may have concerning the external links that we have placed on our Website.

4. PRIVACY

SoundIntuition respects your right to privacy of your personal information.  Please review our Privacy Policy on our Website for details on the manner in which we collect, use, disclose and otherwise manage any of your personal information.

5. SOCIAL NETWORKING AND FORUMS

SoundIntuition cannot be responsible for the content or accuracy of any information posted on blogs, and will not be responsible for any reliance or decisions made based on that information.  SoundIntuition reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of these Terms.  

6. DISCLAIMER OF WARRANTIES

The Content of online courses has been reviewed and approved for continuing educational purposes (only) by the recognized professional bodies indicated, and SoundIntuition does not guarantee and is not responsible for: 

  • the quality, completeness, copyright compliance or accuracy of the Content; and 
  • the currency of the Content, or that the Content reflects the latest thinking or advances in the field of audiology. Best practices and treatments change rapidly and some Content may be out of date.

 
The Content and services provided on this website by SoundIntuition are being provided on an “as is” and “as available,” without warranties or conditions, including any statutory or implied, either express or implied. SoundIntuition disclaims, to the fullest extent permissible under applicable law, all warranties, express or implied including but not limited to implied warranties and conditions of merchantability, fitness for a particular purpose, non-infringement, that the website or content will be accurate, reliable, complete or current, that the operation of the website will be uninterrupted or error-free, that defects or errors in the website or content will be corrected, that the website will be free from viruses, malware, worms, or other harmful components or that communications to or from the website will be secure and/or not intercepted.
You acknowledge and agree that you are using the website and the contents, if applicable, at your own risk and liability.


Persons appearing in videos and those providing blogs may from time to time refer to their own products and services (not limited to assessments and/or treatments), products and services (not limited to assessments and/or treatments) received, or the products and services (not limited to assessments and/or treatments) of third parties, but the Content is not to be construed as an endorsement, recommendation, or sponsorship of or by SoundIntuition of those products or services.  

7. LIMITATIONS OF LIABILITY

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, NONE OF SOUNDINTUITION OR ITS PARTNERS, OPERATORS, SUBCONTRACTORS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, LICENSORS OR THE PERSONS PROVIDING CONTENT FOR COURSES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM OR IN CONNECTION WITH THE USE OF, OR THE INABILITY TO USE, THE WEBSITE OR ANY CONTENT OR SERVICES, EVEN IF SOUNDINTUITION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 
APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

8.INDEMNITY

You agree to indemnify and hold harmless SoundIntuition, its partners, operators, subcontractors, directors, officers, employees, affiliates, agents, licensors and the persons providing content for courses from and against any and all losses, expenses, damages, claims, fines, penalties, costs and liabilities (including reasonable legal and accounting fees), resulting from (a) any content you (or anyone acting under your password or user name) submit, post, transmit or make available on the Website and/or (b) your (or anyone acting under your password or user name) use of this Website, connection thereto, and/or (c) any violation by you (or anyone acting under your password or user name) of these Terms.

9. TERMS OF COURSE PURCHASE

Registration
To use the Website, you will be asked to register. You agree (i) to provide true, accurate, current and complete information about yourself as prompted by our registration form; and (ii) to maintain and promptly update the information you provide to keep it true, accurate, current and complete. If SoundIntuition believes your information is untrue, inaccurate, not current or incomplete, it reserves the right to suspend, block or terminate your access to and use of the Website.  
You are responsible for maintaining the confidentiality of your account information and for all activities that occur in your account. You must notify SoundIntuition immediately of any unauthorized use of your account or any other breach of security, and to ensure that you exit from your account at the end of each session. SoundIntuition is not liable for any loss or damage arising from your failure to protect your account information.

Online Courses
For Online Courses, you understand and agree that:

  • courses are purchased for a single student/user;
  • they may not be shared with others (e.g., used in a classroom setting); 
  • SoundIntuition does not grant continuing education units (“CEUs”) but rather provides CEU opportunities.  These are granted by the applicable governing body (“CEU Body”) that provides and approves the course content, and not SoundIntuition;
  • not all courses are eligible for CEUs, and a single course may attract a different number of CEUs from different CEU Bodies; 
  • courses requiring test completion must be passed to be eligible to obtain the associated CEUs.  The threshold for a pass is set and governed by the applicable CEU Body that provides and approves the course content, and not SoundIntuition; 
  • you are responsible for reading and understanding the CEU units associated with each course;  
  • if you authorized SoundIntuition to do so when registering, test results and related information will be shared by SoundIntuition with the CEU Body granting the CEUs for the course without notice to you;
  • SoundIntuition does not share failures with the CEU Body, nor does it report how many times you took a test before passing
  • once you have registered for a course, you have 30 days to begin the course and related tests -- all courses will expire one year from the date of online publication/release, regardless of when the course is started; 
  • once a course is started
    • you have 7 days to complete the course and any tests to earn the CEUs (as applicable).  
    • if you do not do so within 7 days, a failure grade will be assigned and you must re-purchase the course to try again;
    • you have 3 attempts to take any required tests for the course – if you fail three times you must re-purchase the course to try again;
    • failures are counted as an attempt, but as noted above are not reported to the specific CEU Body/ies for the course;
  • once a test is started, you must complete it – closing your browser for any reason before completing a  test is counted either as a failed attempt to pass the test; or failure of the course itself if it was a third attempt at taking the test.  

Rewards Program – Points 
Points are assigned at a ratio of one point for every twenty dollars spent on the purchase of SoundIntuition courses. Points can be used to purchase courses, in whole or in part, at a value of one point per dollar. They can be redeemed at any time.

Reports to CEU Granting Bodies
If (but only if) you authorized us to do so when registering, we provide reports regarding courses completed and user information to the CEU body or bodies you specify, automatically on completion and without prior notice to you. 

Customer Feedback 
Upon completion of our courses, please give us your feedback. Our quality assurance team uses this data for proactive continuous improvement. 

10. REFUNDS

If a Course is Cancelled 

  • If an Online Course is cancelled by SoundIntuition, a full refund will be returned to the participant using the same method of the original payment.   Refunds for Online Courses will be provided so long as you have not started the course.  
  • Refund Policy for Online Courses
  • Purchase of any SoundIntuition product (Quick Courses, Read ‘n’ Play Listen ‘n’ Talk, Observation Opportunities, Theory in Motion and Communication Change Documentaries) grants you immediate access to the course and therefore we cannot offer a refund once a user has started a course, unless the course is cancelled by SoundIntuition. 
  • If your computer or Internet browser malfunctions, for whatever reason, rest assured that our server maintains a real-time electronic record of your activity. Should any questions arise as to the partial or full completion of a course, those records can be accessed by SoundIntuition. If you feel the online functionality has malfunctioned should immediately contact SoundIntuition by emailing support@soundintuition.com.

Refund Policy for Warren Estabrooks Speaker Series (WESS) Conference
Cancellations must be made by email and if cancelled at least sixty (60) days prior to an event, your refund will be in full. If cancellation is made less than sixty (60) days before an event, the refunded amount will be less a $50 admin fee.   

Withdrawal from a Course 
Nonattendance of a course is not considered an official withdrawal and is therefore not eligible for a refund.  

Official withdrawals are accepted in the following ways:

  • by email at support@soundintuition.com
  • by mail, postmarked by the appropriate deadline

11. GENERAL AND OTHER TERMS

Termination
SoundIntuition may, in their sole discretion, cancel or terminate your right to use the Website, or any part of the Website, at any time without notice. In the event of termination, you are no longer authorized to access the Website or the part of the Website affected by such cancellation or termination. The restrictions imposed on you with respect to both Content and the Website set out in this Agreement shall survive. SoundIntuition shall not be liable to any party for such termination.

Amendments 
SoundIntuition reserves the right at any time and from time to time and in its sole discretion, change these Terms as it relates to future use of the Website, by posting a revised Terms on the Website. By using the Website after the revised Terms has been posted, you accept and consent to be bound by the revised Terms. You may not change the Terms in any manner. At any time and to notify you by posting an updated version of the Terms on this Website. 

You are responsible for regularly reviewing the Terms. 

Continued use of the Website after any such changes shall constitute your consent to be bound by those changes.

Applicable Laws
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada and the applicable federal laws of Canada, and you agree that any dispute with SoundIntuition shall be submitted to a court of competent jurisdiction in the judicial district of the City of Toronto, in the Province of Ontario, Canada and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of these courts in respect of all disputes.
All provisions of these terms are severable.  That means that if any provision of the Terms is unlawful, void, or unenforceable, then that provision shall be severed (considered deleted) from these Terms but that severance does not affect the validity and enforceability of the remaining provisions.
These Terms and any and all other legal notices or statements posted on the Website constitute the entire agreement between you and SoundIntuition with respect to the use of the Website, including the Content.

Notice
Notices to you may be made via email or regular mail, or posted on this Website (in the case of changes to these Terms or to the Website). 

Complaint Resolution
Please express any concerns to us by e-mail at support@soundintution.com.  SoundIntuition staff investigates every expression of customer dissatisfaction that we receive. 
SoundIntuition is committed to the very best customer experience possible with our online products and data from customer feedback is used to update the knowledge base content of our Website ensuring that, to the best of our ability, issues are mitigated and are not repeated.  

Other Terms

Account Security
You are responsible for maintaining the confidentiality of your password and we strongly recommend that you do not disclose your password to anyone.  You must notify us if you become aware of a potential breach of security, such as unauthorized disclosure of your user name and password.

Payment Method
Payment is accepted by major credit card using a secure third-party payment-processing service. When you pay by credit card, you agree that SoundIntuition may charge the fee and other charges payable to SoundIntuition, including applicable taxes, to your credit card. SoundIntuition is not responsible for any charges incurred from exceeding your credit limit. No credit card information is stored on the servers that house our website.
