SoundIntuition is committed to keeping your personal information confidential and secure, including collecting, using and disclosing personal information responsibly and only to the extent necessary for the products and services we provide. We also try to be open and transparent as to how we handle personal information. This policy sets out what type of information is collected, how the information is used, and with whom the information is shared. 

WHAT IS PERSONAL INFORMATION? 

Privacy legislation in Canada defines "personal information" as information about an identifiable individual. Personal information includes information that relates to their personal characteristics (e.g., date of birth, home address or phone number, etc.).  Personal information is to be contrasted with business information (e.g., an individual's business address and telephone number), which is not protected by privacy legislation.  

WHY WE COLLECT AND USE PERSONAL INFORMATION

Primary Purposes: We collect personal information from you when you create an account (a “User Account”) with us and when you use our services (the “Services”) in order to provide you with access to the Services. 

We also collect the following information for the following purposes:

  1. CEU: personal information to track your course purchases, continuing education unit (“CEU”) data, points acquisition as part of a rewards program as well as to recommend and expedite the purchasing of new course material. 
  2. Billing: contact information for the purposes of sending you invoices, statements, reminders and notifications. 
  3. Reports: users’ information regarding completed courses to be supplied to the continuing education unit (“CEU”) body or bodies you specify in your account profile, if (but only if) you authorize us to do so when you register.
  4. Regulatory Accountability: personal information in order to comply with any legal or regulatory obligations or the rules of professional governing bodies.   
  5. Internal Purposes: personal information for our internal purposes, including administration of our website, market research, data analytics and to meet our legal obligations.

 

PROTECTING PERSONAL INFORMATION

We protect personal information from loss, misuse, unauthorized access and alteration by using physical, organizational and technological measures, including:

  • standard security practices and tools and internal policies and practices consistent with practices for similar types of services;
  • personal information is stored on servers using state-of-the-art encryption; 
  • no credit card information is stored on the servers that house our website; 
  • purchases are processed through reputable third-party payment processing services on an outside website; and 
  • we collect, use and disclose personal information only as necessary and in accordance with this privacy policy. 

We may not provide directly all the Services. We may use third-party service providers to process or handle personal information on our behalf, such as in processing payments. Some of our service providers may be located outside of Canada and subject to foreign legislation. We will use contractual or other means to provide the highest available level of protection while personal information is being processed by a third party.

RETENTION AND DESTRUCTION OF PERSONAL INFORMATION

We retain personal information in compliance with the requirements established in law.  Personal information is stored on our server for the duration that a User Account remains active, or until such time as the Account is closed by either the user or by our personnel. Accounts are automatically closed and their data purged after 24 months of inactivity. 

LAW ENFORCEMENT REQUESTS

We will disclose personal information without your knowledge or consent if we receive an order, subpoena, warrant or other legal requirement issued by a court, tribunal, regulator or other person with jurisdiction to compel disclosure of your personal information. If we receive a request from a police officer or other law enforcement agency for access to your personal information in the course of an actual or potential investigation, our policy is to require the police officer or law enforcement agency to obtain an order, subpoena or warrant, unless the information is urgently required to prevent serious bodily injury or serious damage to personal property.  If we receive a written request from a police officer or other law enforcement agency with authority to request access to your personal information in the course of an actual or potential investigation into a breach of a law, our policy is to provide the requested information.

CONSENT

By providing your Personal Information to us, you agree that we may collect, use and disclose it in accordance with this Policy and as otherwise permitted or required by law. However, we may seek your consent to use or disclose Personal Information after it has been collected in cases where we wish to use or disclose the information for a purpose not previously identified or expressed in this Policy.

In browsing the Internet, you will encounter a technology called “cookies”, which are small data files that are saved to your device when you visit our website(s). These are commonly used to provide you specific information from a website, and to provide the website’s operator information about you. We may use both session cookies and persistent cookies. A session cookie is a temporary file which is only active while you are on the website and is erased once you close your browser. Unlike a session cookie, a persistent cookie is not deleted when you close your browser and will remain on your device indefinitely.

This information may be used for advertising and marketing initiatives after you conclude your session on the SoundIntuition website. Our Website may contain links to other sites. This Policy only applies to Personal Information that we collect, use and disclose. We are not responsible or liable for the privacy practices of third parties, and we strongly recommend that you review their privacy policies before you disclose Personal Information to them.

We have relationships with ad server companies that may collect basic information such as your domain type, IP address and clickstream information. For information on how you may opt-out of such collection of your information, please contact our Privacy Officer as set out in the Contact Information section below.

 

ELECTRONIC COMMUNICATIONS

Email is our preferred method of communicating with you. Unless you object, we may use unencrypted plain text or HTML-based emails when communicating with you. These emails, and other electronic communications from us, may contain information that is confidential or privileged, unless you instruct us not to send such information electronically.

While we make every effort to secure all electronic communications within our control, there are inherent risks involved with exchanging information electronically. For example, third parties may accidentally or deliberately intercept this information. We are unable to accept responsibility or liability for any damages you may suffer as a result of the interception, alteration or misuse of information during electronic exchanges.

You may access and update your personal information at any time. To help protect your privacy, we take reasonable steps to verify your identity before granting access to your information.

You may access your User Account and dashboard at any time by logging into your account. You are responsible for ensuring that you do not share your account credentials with others.

We rely on you to advise us of any changes to your personal information that may affect our ability to provide you with the Services.

We reserve the right to add, delete, modify or otherwise amend this policy, as we deem appropriate, including, where necessary, changes to reflect current regulations and industry practices. By continuing to use our services after this policy has been amended, you will be understood to have consented to the collection, use, and disclosure of your personal information in accordance with the amended policy.
