Overview 

SoundIntuition’s business is based on the development of the valuable intellectual property which is behind SoundIntuition’s unique learning and continuing education products. Intellectual property (IP) and the rights in that property provide a basis for protecting SoundIntuition’s industry-leading ideas, designs, materials, information and branding.

SoundIntuition owns various types of intellectual property (copyright, trademarks, database rights, confidential information and know-how) and provides wide and effective use of its intellectual property to all people within the SoundIntuition organization and those with whom SoundIntuition engages. With so many people involved or engaging with SoundIntuition globally, SoundIntuition needs to ensure that the ownership, integrity and value of its intellectual property rights is not prejudiced.

SoundIntuition’s intellectual property rights are protected by various means including national laws, international treaties, Non-disclosure Agreements (also known as Confidentiality Agreements), employment contracts, consultancy contracts and international trade mark and domain name registrations.

This policy is supplementary to these protections and it is a condition of relevant contracts entered into by SoundIntuition that those who use and create SoundIntuition’s intellectual property will adhere to this policy.  Any breach of the policy will be taken seriously and may result in appropriate legal action.

In simple terms, the protection of SoundIntuition’s intellectual property means that it is unlawful for anyone to use, copy or modify our intellectual property without permission.  This extends to, for example, another person using a trade mark which is confusingly similar to one that belongs to SoundIntuition, or copying a significant part of copyright material.

Of course, in expecting others to respect SoundIntuition’s’ rights in its intellectual property, it is imperative that SoundIntuition’s respect the rights of others in their own intellectual property.

Different countries’ laws vary on each type of intellectual property, but in essence the rights are broadly the same in most countries where SoundIntuition is active.

Infringement

SoundIntuition has a zero tolerance policy towards intellectual property infringement.  Examples of infringement include:

  • Unauthorized use of any of our trade marks (names or logos) or any mark which is similar, and therefore likely to mislead the public into thinking that the unauthorized user is somehow associated with SoundIntuition
  • Unauthorized use or copying of any of SoundIntuition materials protected by copyright, such as learning materials, profiles, software etc.
  • Disclosure of confidential information, business planning information and other information which is commercially sensitive or which is confidential between SoundIntuition and our clients.

Intellectual Property Security

SoundIntuition will ensure that appropriate security measures are taken against the creation, use and disclosure of valuable intellectual property without appropriate protection in place.

Ensuring intellectual property rights are secure means guaranteeing the confidentiality, protection, development and ownership of intellectual property, defined as follows:

  • Confidentiality means that only people who are authorized to use confidential information have access to it.
  • Protection means the legal protection necessary to safeguard ownership of intellectual property rights for SoundIntuition.
  • Development means that licensees should be able to use intellectual property owned by SoundIntuition for authorized purposes and develop that intellectual property for the benefit of SoundIntuition.
  • Ownership means that all intellectual property developed under a licence granted by SoundIntuition is properly reported so that SoundIntuition can take measures to secure the legal ownership of that intellectual property.

 Security procedures include:

  • Non disclosure agreements – any person or company who SoundIntuition wishes to provide valuable information to is required to sign a Non- disclosure Agreement.
  • SoundIntuition licences – all parties working with SoundIntuition’s materials that are protected by copyright are required to enter into a licence which provides that existing intellectual property owned by SoundIntuition, and intellectual property developed in the course of the licence, are owned by SoundIntuition.

Intellectual Property of Others

As a responsible, professional business with a hard-earned reputation for business integrity, SoundIntuition will not tolerate any infringement of the intellectual property of others, any more than we would tolerate others infringing our intellectual property.
